By accessing or using the ODA Malaysia mobile application, website, or related services (collectively referred to as “ODA Platform”), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using our services.

If you do not agree with these Terms, you must stop using the ODA Platform immediately.

Definitions

“User” / “You” refers to anyone who accesses or uses the ODA Platform, including customers, vendors, riders, and partners.

“ODA Platform” refers to the ODA Malaysia app, ODA Partner app, ODA Rider app, and related digital services.

“Vendor” refers to a business or individual offering goods or services through ODA Partner.

“Rider / Driver” refers to individuals providing delivery or transport services using the ODA Rider or ODA Driver platform.

“Customer” refers to users placing orders or using ODA services.

Acceptance of Terms

By using the ODA Platform, you confirm that you:

Are at least 18 years old and legally capable of entering into contracts;

Have provided accurate and complete information during registration;

Agree to comply with these Terms, our Privacy Policy, and all applicable laws in Malaysia.

Account Registration and Security

You must create an account using valid and accurate personal details.

You are responsible for maintaining the confidentiality of your login credentials.

Any activity under your account will be deemed as your own.

You agree to notify ODA Malaysia immediately if you suspect unauthorized use of your account.

Use of the Platform

You agree to use the ODA Platform only for lawful purposes and not to:

Violate any applicable laws or regulations;

Order or transmit harmful, obscene, or fraudulent content;

Attempt to hack, reverse engineer, or disrupt ODA’s systems;

Use another person’s account without permission;

Engage in activities that may harm ODA Malaysia’s reputation or business operations.

Services Provided

ODA Malaysia operates as a digital platform connecting customers, vendors, riders, and service providers.
We do not own, sell, or control the goods or services offered by vendors or delivered by riders.
All transactions and deliveries are made directly between the users involved.

Orders, Payments, and Fees

Prices, promotions, and availability of products are set by vendors.

Payments can be made through cash, e-wallet, or other supported methods.

Once an order is confirmed, it cannot be canceled or refunded unless approved under ODA’s refund policy.

ODA Malaysia may charge service fees, commissions, or delivery charges as stated in the app.

Vendor & Rider Obligations
For Vendors:

Vendors must ensure product information, pricing, and images are accurate and up to date.

Food and products must comply with local health, safety, and halal regulations (where applicable).

Vendors are responsible for fulfilling orders within agreed timeframes.

For Riders / Drivers:

Riders must possess a valid driving license, insurance, and comply with traffic laws.

Riders must treat all users respectfully and deliver items safely and promptly.

ODA reserves the right to suspend or terminate riders found violating rules or engaging in misconduct.

Commissions and Earnings

Riders and vendors agree to the commission or service fee structure as stated in the ODA Platform or official agreements.

ODA Malaysia reserves the right to revise commission rates with prior notice.

All payouts are subject to verification, deductions (if applicable), and compliance with tax obligations.

Intellectual Property

All content, trademarks, logos, and designs displayed on the ODA Platform belong to Sumhero Sdn. Bhd.
You are not permitted to copy, reproduce, distribute, or modify any part of the ODA Platform without written consent.

Limitation of Liability

ODA Malaysia shall not be liable for:

Losses or damages resulting from vendor or rider misconduct;

Service interruptions, system errors, or unauthorized access to user data;

Delay or failure in performance due to causes beyond our reasonable control (e.g., natural disasters, strikes, network issues).

Your use of the platform is at your own risk.

Suspension and Termination

ODA Malaysia reserves the right to suspend, deactivate, or terminate accounts that:

Provide false information,

Violate these Terms,

Engage in fraudulent or harmful activity.

Users may also terminate their accounts by contacting customer support.

Privacy and Data Protection

Your use of the ODA Platform is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
Please read the Privacy Policy carefully before using our services.

Modifications to the Terms

ODA Malaysia may update or amend these Terms at any time.
Updated Terms will take effect upon posting on our website or app. Continued use of our services constitutes acceptance of the revised Terms.

 Governing Law and Jurisdiction

These Terms are governed by and construed under the laws of Malaysia.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
